My daughter and two grandchildren are being abused by a Mobile County, Alabama, judge. Judge J. Donald Banks has taken the Children from the Mother for an irrelevant and frivolous legal reason. She was forced to testify that she is not Christian. The judge is a Baptist deacon at a local church. She was falsely accused of practicing witchcraft in which an upside-down horseshoe hanging on a nail on her front porch was accepted as evidence. The Children were abducted from kindergarten without her knowledge and without advice of counsel. An emergency hearing the next day produced no evidence that the abduction as justified, however, the judge let the abduction Order remain in effect to trial 1. At trial 1, there was not sufficient evidence to sustain the abduction. The new wife has filed for divorce from the Defendant Father and the Plaintiff Mother has discovered direct evidence of child abuse, both physically and emotionally. At one time the Defendant Father was in hiding with the Children to avoid summons from two different Courts at the same time. The Plaintiff Mother, indigent and representing herself, has filed an Instanter Petition for Custody which the judge ignores. In trial 2, all of the Mother complaints were proven true and all the Defendant Father's counter-claims were either proven false or no effort to prove either way. The judge is treating the Defendant Father as his client by forgiving a child support arrearage of $32,680.00 owed to the Mother. The Defendant Father is the son of an ordained christian minister. The Plaintiff Mother requested the appointment of a Guardian ad litem in hopes of off-setting the obvious bias of the judge in the first trial. The judge appoints his former law partner as GAL and even he determines that the Children's best interest would be served if the Children were taken away from the abusive Father. The Plaintiff Mother filed Rule Nisi against the Father due to his failure to allow the Mother to exercise her court granted visitation rights which the judge ignored also.
There are numerous ethics violations in trial 1 and trial 2 that indicates the court is not honorable by any standard.
